STRATA TITLE ADMINISTRATION - AN INTRODUCTION

Strata Title Adminstration Limited (Strata) began as Accommodation Broker Limited, had a name change to Flathold Property Limited, before becoming Strata Title Administration Limited in 1996.
The sole director is Michael Chapman-Smith. The company has 1,000 shares on the register split between 5 parties, Mr Chapman-Smith has ownership/ control of 67.5% of the shares.

Strata has been involved in several high court actions where they have been dismissed as body corporate secretary. Various rulings from the High Court have deemed parts of the Strata Body Corporate Manual to be 'ultra vires' - ie beyond the legal authority granted to Strata

SUSPENDED FROM CARRYING ON THE BUSINESS OF A REAL ESTATE AGENT - 1989
In March 1989 Michael Chapman-Smith came before the Real Estate Agents Licensing Board (now known as Real Estates Agents Authority) for renewal of his real estates agents licence for Akarana Real Estate Ltd and ARC Real Estate Ltd. A copy of the decision of the hearing is not available on line. It was available from the offices of the REALB, with the change to the REAA I am unsure if this is now available. The outcome of the hearing was that Michael Chapman-Smith was suspended for practicing for two years.
The board comments within their decision included:
  • "Mr Chapman-Smith (CS) deliberately and knowlingly made a false declaration"
  • CS "knew they were untrue"
  • CS "deliberately misled the institute"
  • CS "tailored his evidence"
  • "The architect of the planned series of deceit was Mr Chapman-Smith, showing a lack of integrity on his part."

Akarana Real Estate Ltd has now become Strata Realty Limited and its registered office is on the same floor as Strata Title Administration.

In April 2009 Michael Chapman-Smith made an 8 page submission to the committee.
